Months after a traffic stop made by Larimer County Sheriff’s officers revealed a mobile methamphetamine lab operation, the two people involved have been charged with multiple drug and alcohol offenses.

In August 2011, Aubrey Ann Holland, 24, was pulled over with Franklin Ray Runyan, 34, as her passenger. Officers found equipment and materials in the vehicle for meth production. Holland was charged with driving under the influence of alcohol, but was dismissed without prejudice at the time.

“If we would’ve charged her with the DUI at that time, we couldn’t have filed the drug charges … otherwise it is a double jeopardy,” said John Schulz, Public Information Officer for Larimer County Sheriff’s Office.

A double jeopardy would legally forbid a person from being charged more than once for the same incident. The meth lab investigation required the attention of several agencies and so the results were not filed until now.

“Anytime multiple agencies are involved, these things always take longer,” Schulz said.

Holland was arrested on seven charges, including unlawful possession of materials to make methamphetamine and amphetamines and unlawful manufacturing of methamphetamine, as well as driving under the influence among others. She is being held at Larimer County jail on a $100,000 bond.

By the time the drug charges were finally filed, Runyan was already in custody at Larimer County jail for a separate incident from Oct. 3 where he tried to run down a deputy officer with his vehicle. He was put in jail on a $200,000 bond originally. Now, with the additional drug charges, his bond sits at $300,000.

Holland’s first court appearance is set for Apr. 23, and Runyan’s first court date is May 3.
