ASPEN, Colo.—A judge has upheld a bomb-threat charge against a Glenwood Springs man accused of calling in a false threat to an Aspen club, but two other counts have been dismissed.
The Aspen Times reports () a judge on Monday dismissed charges of second-degree assault on a police officer and assault on a police officer. She said Pitkin County prosecutors’ failure to release evidence in a timely manner to defense attorneys for Asa Robinson led her to drop the charges.
Robinson is accused of calling in a bomb threat to Belly Up on the night of a sold-out event in November. The club was evacuated, but customers were allowed back inside after police found no explosives. Investigators say the call was traced back to Robinson’s phone.
