DENVER—A federal judge says a lawsuit challenging the constitutionality of Colorado’s Taxpayer’s Bill of Rights, or TABOR (tay-bor), can move forward.
The voter-approved TABOR amendment limits state spending and bars lawmakers from raising taxes without a vote of the people.
A group of Democratic and Republican officials has filed a legal challenge of the measure. They argue TABOR violates the Constitution by taking away elected lawmakers’ ability to tax.
State Attorney General John Suthers had argued the plaintiffs hadn’t suffered any concrete injury and didn’t have legal standing to sue.
But The Denver Post reports ( ) a federal judge ruled Monday that plaintiffs who are current Colorado legislators have the legal standing to bring the complaint.
