DENVER—Relatives of a street preacher who died after Denver sheriff’s deputies restrained him while he was in custody are accusing city officials of delaying resolution of their lawsuit to keep it from going to a jury.

The city has filed notice it will appeal a judge’s decision to dismiss the city’s claim that its deputies shouldn’t be tried because they have legal protection from liability. A lawyer for the city tells the Denver Post () the city just wants to protect the rights of its employees.

According to the lawsuit, 56-year-old Marvin Booker died after five deputies placed him in a neck hold and shocked him with a stun gun after he had been handcuffed. He was jailed on charges of possession of drug paraphernalia.
