A has been identified, as has the deputy.

Robert Alan Penning, 45, died Jan. 14 after he was shot by Senior Deputy Manuel Aragon, said Sgt. Paul Gregory, a sheriff’s office spokesman.

The incident happened at about 6 p.m. near the intersection of Quebec Street and East 144th Avenue.

Penning allegedly pointed a gun at Aragon, who was responding to a a report of a drunken driving suspect.

The sheriff’s office said Penning did not comply with verbal commands Aragon gave to Penning, and the deputy fired two shots when a hand gun was pointed at him.

Penning was pronounced dead at the scene.

An investigation is ongoing.
