With insufficient proof from the investigation, the Weld County district attorney will not file charges against a man .

“We were not able to meet the deadline, and we are requesting additional information from the investigation,” said Heath Montgomery, a spokesman for the Weld County District Attorney’s Office.

For now, the man, David Calderon, 38, will be freed from the Weld County Jail. Charges still could be filed at a later time.

The 16-year-old girl was missing for more than a day. Police issued an alert seeking her after she sent troubling messages to friends on social media.

When the girl was found, she told police she had been kidnapped from the Hays Market parking lot.

, the girl claimed she was walking home at night and approached a man in his vehicle to hear him better as he tried to ask her for a lighter, but he pulled her into the vehicle through the driver-side window.

The girl said he drove her to various locations on what she believed to be drug deals. At his home, the girl said, she was fondled and threatened with a gun.

The man told police there was no sexual contact between the two, just a hug. He told police the girl had asked him for a ride and told him she was 18 years old.
