DENVER—A Denver police officer who admitted using a department-issued cell phone to send sexually explicit text messages to a woman he met on-duty is appealing a 90-day unpaid suspension.

Manager of Safety Alex Martinez says officer Jay Whittenburg violated the department’s rules against immoral conduct and sexual misconduct when he sent the woman a series of messages after encountering her while patrolling her neighborhood late last year.

According to the Denver Post ( ), investigators could not determine who initiated contact because many text messages were missing and the woman’s statements were inconsistent.
