BOULDER, Colo.—The city of Boulder is appealing two rulings by the Colorado Public Utilities Commission that the city believes could make it more difficult to acquire Xcel Energy’s assets to create a municipal energy utility.

Last fall, the PUC ruled that it has authority over which properties and facilities outside city limits that Boulder could acquire through eminent domain. Another ruling would require the city to apply to the PUC before beginning condemnation proceedings against Xcel to claim property.

Commissioners say they have an obligation to protect regional electricity reliability.

According to the Boulder Daily Camera ( ), Boulder is asking a district court judge to intervene. The city says it also may go ahead with condemnation proceedings before the judge rules.
