BOULDER — The felony case against former Boulder police Detective Jack Gardner, who is accused of tipping off a suspect who was being investigated for Internet sexual exploitation of a child, was transferred to Boulder District Court on Thursday morning.

Gardner, 56, was scheduled by Boulder County Judge John Stately for an arraignment Feb. 20 before Boulder District Judge Patrick Butler.

Gardner has been charged with being an accessory to a crime — a Class 5 felony — and misdemeanor counts of first-degree official misconduct and obstructing a peace officer.

Because Gardner is free on bail and the most serious charge against him is a Class 5 felony, he was not entitled to a preliminary hearing Thursday in Boulder County Court.
