MONTROSE —A judge has denied a request for a new trial for a man who was convicted of vandalism for tearing down barricades on federal land in Montrose County.
The Montrose Daily Press reported Friday that U.S. District Judge Robert E. Blackburn dismissed David Justice’s arguments as “legal fallacy.”
Justice, whose given name is Stanley Hugh Anderson, was convicted in September after damaging Bureau of Land Management property at the Cushman Creek Trail. He argued the road is under county and state jurisdiction, not federal. He also said the judge should have instructed the jury about the state’s definition of a highway.
