GRAND JUNCTION, Colo. (AP) — A Mesa County prosecutor is moving to dismiss a charge of felony arson in the case against Paige Birgfeld’s alleged killer because the statute of limitations has expired.

Police arrested 63-year-old Lester Ralph Jones on charges of murder, kidnapping and arson in the death of Birgfeld, of Grand Junction. Birgfeld’s remains were found in a dry creek bed in 2012.

According to the Grand Junction Daily Sentinel (http://tinyurl.com/njao53z), Jones is still charged with first- and second-degree murder and second-degree kidnapping in connection with the June 28, 2007, disappearance and death of Birgfeld.

Jones is being held at the Mesa County Jail in lieu of $2 million bond. He was arrested on Nov. 21.
