Prosecutors will be able to use a video taken in a courthouse holding cell as evidence during the Aurora movie theater shooting trial.
The video shows James Holmes doing something that an Arapahoe County sheriff’s official said caused , though more details have not been released. Defense attorneys did not learn about the video until just recently, years after it was filmed. Because jail administrators took so long to disclose the video, the defense asked the judge overseeing the case to bar prosecutors from using it at trial.
In , Judge Carlos Samour rejected the request, saying the prosecutors shouldn’t be punished for the action of jail officials.
