El Paso County authorities say the FBI has arrested a man wanted in a Black Forest double shooting early Friday morning that left one person dead.
Maxwell Garihan, 59, was arrested late Friday on suspicion of first-degree murder and attempted first-degree murder in the shootings. The county sheriff’s office says he was taken into custody at 8 p.m..
Officials say domestic issues and complications surrounding divorce proceedings precipitated the shootings.
The county sheriff’s identified the man slain in the shooting on the 4100 block of Bobbie Kay Place as 57-year-old Alan Havens, was a long time resident of Black Forest.
Investigators say Havens was shot in the head.
An unidentified woman who was also shot in the head is in good condition and “expected to make a full recovery,” according to Jacqueline Kirby, spokeswoman for the sheriff’s office.
A dog was also killed in the shooting.
Kirby said Garihan and the woman were in the process of divorce and “there was some domestic issues going on, definitely.” The sheriff’s office said the woman shot had taken out a restraining order against Garihan but that the order had not been served.
According to The Gazette, the woman filed for divorce and sought the restraining order on the same day in mid September. The restraint request said the woman had been repeatedly threatened by Garihan the previous week, specifically through notes left in her home.
“It’s very multi-faceted,” Kirby said.
