Anyone caught smoking anywhere on Boulder County’s parks or open space lands could face a $75 fine, under a proposed regulation being considered Tuesday by Boulder County commissioners.
If it’s the smoker’s second offense, the penalty would jump to $150. If it’s the third, he or she would risk a $300 fine.
Current rules and regulations are silent about visitors smoking on the tens of thousands of acres of county-owned open space properties.
The smoking ban is one of a number of potential revisions to Boulder County rules and regulations the county staff and the Parks and Open Space Advisory Committee have recommended that the commissioners adopt.
And while the general smoking ban would apply to pot as well as tobacco, the county would also specifically prohibit “consuming marijuana or any marijuana derivative” — including marijuana-infused food or drink — within any county park or open space area.
Boulder County’s parks and open space rules and regulations were last updated in 2011.
