A Colorado Springs fitness enthusiast is suing for invasion of privacy because she claims a sales clerk at a Reebok outlet store in Castle Rock spied on her and took a video of her trying on clothes in a changing room.
Christina Selvig, a mother of four, filed her lawsuit Thursday in Douglas County District Court against Reebok International Ltd. and the alleged peeping Tom, Austin Kyle Baker.
Baker, now 19, faces a misdemeanor charge of invasion of privacy for sexual gratification. The public defender representing him for the criminal charge did not return telephone messages seeking comment. The store manager of the Reebok store, located in the Outlets at Castle Rock shopping center, declined comment and referred questions to loss prevention for the company.
The lawsuit seeks unspecified damages for invasion of privacy against Baker and for negligence against Reebok.
The lawsuit said that on Dec. 31 Selvig was in the changing room when she was shocked to see Baker looking over the top of the wall into the changing room. She contends that she then screamed and the man fled.
In an interview, Selvig said Baker later confessed to law enforcement authorities and turned over his telephone. She said law enforcement forensics personnel were able to find video of her on the telephone as well as videos of other women that had been deleted. Selvig said two employees were fired over the incident.
Selvig said she noticed Downs was spying on her while she was in her underwear, as she was about to try on a sports bra.
“It’s really been a challenge,” Selvig said. “I think I’m okay, and then I start to talk about it, and I’m not okay. It’s been overwhelming.”
She said that two of her children had gone to the outlet mall with her and her parents. Her father had taken the children to another store in the outlet mall when it occurred, Selvig said.
“At the time, I just kept thinking how bad it would have been if my daughter was in there with me,” Selvig said.
The lawsuit contends that before Baker was arrested, he had secretly watched and video recorded numerous other women undressing in the store’s changing room. It also states that he told at least one other Reebok employee he was secretly videotaping women.
