A 38-year-old man accused of shooting his wife several times during an argument last weekend in Denver has been formally charged with attempted second-degree murder.

The Denver District Attorney’s Office said Tuesday that Eric D. Smith also faces a count of first-degree assault and second-degree assault — both felonies — in the encounter.

“Smith and the victim were arguing in their car over whether or not he should be driving, as he had allegedly been drinking,” the office said in a news released. “The charges allege that Smith shot the victim several times causing serious bodily injury.”

Prosecutors say Smith remains in custody in lieu of $50,000 bail. He is next due in court July 21.
