A Colorado Springs man has agreed to testify against his uncle and father in the slaying of a 14-year-old boy allegedly gunned down over a missing cellphone.
Initially charged with first-degree murder, Raymond David Rogan Jr., 19, will avoid a potential life sentence by cooperating with prosecutors in the July 2015 shooting of Desmond Allen Smith in Memorial Park.
Rogan pleaded guilty July 12 to lesser charges of accessory to murder and attempted child abuse resulting in death. All other counts will be dismissed.
Under terms of the plea deal, Rogan will serve six years in the Youthful Offender System in Pueblo, according to a copy of the plea agreement. A 20-year suspended sentence will also hang over his head should he commit new crimes or cause problems at the Pueblo juvenile facility.
Fourth Judicial District Judge Larry E. Schwartz, who is presiding over the case, will decide whether to adopt the deal at a Sept. 6 sentencing. Rogan will be held without bond at the El Paso County jail until then.
