The driver of a pickup truck that struck and killed a Longmont city employee last month said he saw the cyclist in the intersection at the last minute, according to an arrest affidavit released Wednesday.

Felipe Peralta-Alvarez told Longmont police he thought the traffic light was green as he drove westbound on 17th Avenue, where 46-year-old Shane Swope was crossing northbound on Gay Street.

Swope, a senior civil engineer in Longmont’s Public Works & Natural Resources department, was killed after colliding with the front driver’s side of the white Ford pickup — travelling up to 40 mph — about 12:15 p.m. June 21, according to the affidavit.

Peralta-Alvarez, 24, of Denver, surrendered at  the Longmont Police Department about 7 a.m. Wednesday. He faces misdemeanor charges of careless driving resulting in death and driving without a valid driver’s license. He bonded out of jail  and will eventually appear in Boulder District Court.
