A judge sentenced a 31-year-old Brighton man to 21½ years in federal prison after he sexually assaulted an infant boy he was babysitting, took a picture of it and texted it to other people.
Federal Judge William J. Martinez also sentenced Jamie Sailas to 30 years of supervised released after his release from prison. The prison sentence Martinez gave was near the maximum in the federal sentencing scheme.
“I’ve done something monstrous that I never should have done,” Sailas told the judge shortly before his sentencing Monday morning.
Sailas, a short man, was wearing a 4X-size tan prison jumpsuit. He had previously entered a plea agreement in which two child pornography charges were dismissed in exchange for his guilty plea to a charge of production of child pornography.
Prosecutor Alecia Riewerts said it was virtually impossible for Sailas to have sexually assaulted someone any younger than the infant boy he was babysitting on June 5, 2009.
Sailas was staying at the home of a female friend who had an infant boy who was four to six weeks in age when the assault happened.
A urologist who examined the picture said there was more than a 95 percent chance that the penis in the photograph was Sailas’, Riewerts said.
Sailas also had a cache of 1,900 child pornography pictures, many depicting female infants and toddlers being raped, court records indicate. He traded pornography with other men online. At one point he wrote to a fellow porn distributor: “I also love rape.”
Sailas’ attorney, Matthew Golla, pointed out that Sailas didn’t have an adult criminal history and that the infant will never have a memory of what happened to him. He recommended that Sailas be sentenced to 17½ years in prison.
The infant was taken from the natural mother’s home and adopted by another family.
Judge Martinez said he was extremely affected by a series of victim impact statements he received from children who were depicted in child pornography pictures found in Sailas’ possession.
“I couldn’t get through them all,” he said. “I may be a federal judge, but I am also a human being. There’s a limit of how much of this stuff you can stomach and I had to stop.”
