A reputed Denver gang member who has twice been federally convicted of being was arrested again on the charge Monday, federal agents and court records say.
Brian Keith Pate Mosley was linked to a 9mm Smith and Wesson pistol by DNA, according to a criminal complaint filed in U.S. District Court in Denver.
The Bureau of Alcohol, Tobacco, Firearms and Explosives says it worked with Denver police on the case. The complaint says Mosley also has a state conviction for being a previous offender in possession of a weapon from a 2007 case.
Federally, Mosley pleaded guilty to being a felon in possession of a firearm in a 2010 case and a 2012 case, according to the complaint filed Dec. 9. Court records show in the latter case, Mosley was sentenced in January 2013 and is still on federal supervised released.
Investigators began looking into Mosley most recently after a Nov. 28 shooting near the intersection of 26th Street and Glenarm Place in Denver’s Five Points neighborhood. Responding Denver police officers found Mosley near the scene, where he told police he had been shot at, the complaint says.
During a search of the area, authorities say they found a loaded, 9mm pistol in a yard. According to the complaint, investigators later found Mosley’s DNA on the weapon.
Mosley’s attorney declined to comment Tuesday on the allegations.
