A California woman has sued a snowboarder who plowed into her from behind at Vail Ski Resort, causing severe injuries, .

Hsu Chiang Chou sued Philip Moroco II in Denver U.S. District Court on Thursday for a collision that happened Jan. 17 on Vail Mountain, according to the lawsuit filed Thursday by Denver attorney Russell Hatten.

Hsu Chou is seeking reimbursement for economic and non-economic damages and lawsuit costs including attorneys fees. Damages exceed $75,000, according to the lawsuit. Hsu Chou , the lawsuit says.

The lawsuit says that Hsu Chou was skiing ahead of Moroco, who is from Pennsylvania, on The Star trail, an intermediate run in Blue Sky Basin, when he began snowboarding “out of control” at high speed and struck her from behind.

Hsu Chou’s husband, Chongping Chou, was skiing behind his wife and Moroco and witnessed the collision, court records say.

The sole cause of the crash was Moroco’s negligence, the lawsuit says.

“Defendant, as the uphill and overtaking skier, had the primary duty to avoid skiers below,” the lawsuit says.
