A federal magistrate judge dismissed criminal charges against a 34-year-old Colorado Springs man after federal prosecutors did not show up to present evidence at his preliminary hearing, court records indicate.
Magistrate Judge Kathleen Tafoya and released Madison Dwayne Robinson from custody on March 13, according to a court records.
“This court finds that there has been no evidence presented that the defendant committed the crimes charged in the complaint and that therefore the court must dismiss the complaint and discharge the defendant,” Tafoya’s order says.
Attempts to reach Massachusetts prosecutors and federal agents Thursday were unsuccessful.
Robinson had been charged with sexual exploitation of a minor, receipt of child pornography and enticement for sexual conduct, according to an arrest warrant by Michael Morizio, a special agent at Homeland Security Investigations’ office in Springfield, Mass.
Robinson had worked at the Griffith Centers for Children Education, 10 Farragut Ave., and at Loyal Source Government Services, 2 N. Cascade Ave., both in Colorado Springs, according to an arrest warrant.
According to a federal complaint out of Massachusetts, a man posing as a teenager coaxed a 14-year-old girl to perform sex acts for him online.
A criminal investigation began on June 15 in Chicopee, Mass. Federal prosecutors and members of Homeland Security’s Boston High Intensity Drug Trafficking Area Financial Task Force got involved.
