Measure to require arbitration for construction defects disputes gets the ax in the House

A day after a construction defects reform bill , another bill aiming to boost condominium construction in Colorado met its death Thursday.

Senate Bill 156, which would require binding arbitration rather than litigation in a construction defects dispute, but was laid over in the House State, Veterans and Military Affairs committee until after the legislative session ends on May 10. That means the bill is due to die on the calendar.

The fate of SB 156 is not surprising last month.

Most of the have either died or are headed in that direction, meaning HB 1279’s requirement that a majority of homeowners give consent to a defects claim action before one is taken is the only facet of the issue to have been amended in 2017 so far.
