A man accused of killing his 13-year-old son won’t return to Colorado to face trial as quickly as expected.
Mark Redwine was expected to waive extradition this week and be returned to La Plata County, where he’s been indicted on suspicion of second-degree murder and child abuse resulting in Dylan’s death.
But the hearing was canceled, said Whatcom County, Wash., prosecutor Dave McEachran. Redwine has been held in Washington since his arrest there July 22.
“He and his attorney did not want to go ahead with the waiver,” McEachran said Thursday.
Redwine still can waive extradition at any point during his incarceration in Washington, or he can wait for an extradition request from Colorado’s governor, forcing his return, McEachran said.
“So either way, it doesn’t matter.”
Colorado Lt. Gov. Donna Lynne signed that request July 28, saying she respectfully demanded that Redwine be delivered to La Plata County sheriff’s Capt. Larry Foukas and returned to the state “to be dealt with according to law.”
Redwine’s next court appearance is set for Aug. 17. Prosecutors can request a continuance if Lynne’s request has not been processed.
