An effort to block Colorado’s homeowners associations from banning dogs based on their size or breed died Monday in the Democratic-controlled House.

went down on a 34-29 tally.

The measure was backed by Rep. Paul Rosenthal, a Denver Democrat, who ran into a problem several years ago when he had to watch his brother’s canine, a Samoyed and golden retriever mix. The legislation would not have affected HOA rules on barking, dog waste or the number of dogs allowed in a home.

HOA groups pushed back against the bill, saying it infringed on homeowners’ rights.
