
The Denver District Attorney’s office has dismissed criminal fraud charges against a Denver business man, acknowledging prosecutors lack evidence to prove the case.
Denver District Judge John Madden IV dismissed the case against Bertrand Theodore Ungar on March 19, according to court records.
His decision followed a motion by District Attorney Beth McCann to dismiss the case because prosecutors would be unable to prove the case against Ungar beyond a reasonable doubt.
“My client has maintained his innocence regarding the charges levied against him since the initial filing of this case by the Denver District Attorney’s Office,” Denver attorney Adam Kendall said in an email.
Ungar was arrested Nov. 9, 2017, for allegedly failing to disclose to investors that he was not licensed to sell securities in an online streaming platform featuring motorsports programming in Colorado.
