A man accused of shooting a scooter rider after a verbal argument in Denver is under investigation for attempted murder, police said.

Denver police officers responded to the shooting  just before 11:45 p.m. on April 3, according to an arrest affidavit. When they arrived, they found a man who had been shot.

The victim told police that he was shot by a man in the front passenger seat of a white SUV while stopped at a red light, according to an arrest affidavit. The passenger was yelling at people at a nearby bus stop before he shot the scooter-riding victim, one witness told police in the affidavit.

That passenger, identified by police as , reportedly yelled at the victim, asking if he “got a problem,” the arrest affidavit stated. The victim responded that he did not have a problem, at which point Apodaca pulled out a handgun and shot him, the victim told police in the arrest affidavit.

Apodaca was arrested on suspicion of attempted first-degree murder in the shooting on April 4, according to Denver County Court records. One day later, he was released on a $75,000 bail, court records show.

That witness heard one gunshot before the car sped away, police said.

Officers found the car matching the suspect vehicle’s description minutes after responding to the shooting and stopped the driver, according to the affidavit. Four people inside the car were detained, including Apodaca, police said in the affidavit. One of the other passengers in the car identified Apodaca as the shooter.

Apodaca is next scheduled to appear in Denver County Court on April 21 for an advisement hearing, court records show.

This is a developing story and may be updated.
