Companies involved in the manufacture and sale of allegedly hazardous windows have agreed to pay a combined total of $32.5 million to settle a class-action lawsuit.
The suit, filed in 1999 in Douglas County District Court, has been settled piecemeal. The final agreement was reached only recently, said Denver lawyer Scott Sullan, who represents Colorado homeowners Merrill F. and Mary Jean Rowe and other members of the class action.
The companies include the now-bankrupt Oldach Window Corp. of Colorado Springs, as well as window sealant maker Morton International of Indiana and distributor Smalley and Co. of Colorado. The suit claims that homes with Tiltmaster 2000 windows suffered various damages. Owners eligible to file a claim are in the process of being notified, Sullan said.
