DURANGO – La Plata County Court Judge Martha Minot agreed to postpone until Oct. 23 the jury trial for Robert Orio of Orio’s Roadhouse, who faces criminal prosecution for violation of the statewide smoking ban.
Orio claims his bar is exempt from the law because at least 5 percent of his revenue comes from tobacco sales.
The prosecution’s witness is unavailable for the original trial date of Oct. 16.
