The criminal court file on a young woman accused of murdering her newborn child remained under seal today by order of the judge in the case.

The prosecution and defense attorneys both argued that the privacy of the dead newborn’s father, who is under 18 years old, would be violated if the file was opened and District Court Judge Nancy Hopf agreed.

The judge, however, did unseal the calendar of the case for Addie Kubisiak, saying it was never her intention to seal it anyway.

The original complaint was also unsealed. It stated that the baby had been named Tristen.

The Denver Post has filed a motion to unseal the entire case file and Hopf ruled against the newspaper today.

Kubisiak, 18, is a freshman at Western State College in Gunnison. She graduated from Ponderosa High School in Parker in 2006. She faces two felonies, for first-degree murder of a child under 12
by a person in a position of trust and child abuse resulting in
death, as well as a misdemeanor for concealing a death.

The murder charge carries a possible sentence of life in prison or
the death penalty. Prosecutors could not discuss whether they would
seek the death penalty against Kubisiak because of a gag order in the case.

Douglas County authorities have said they believe Kubisiak gave
birth in a car last fall while returning to her Parker home from
college.

Gunnison police reportedly found the remains of a baby during a
search of her Western State dormitory, and Kubisiak was
arrested in January.
