LONGMONT, Colo.-
A man sentenced to 60 days in jail in the death of his 2-year-old son has been arrested again following a car crash.
Gil Smith, 44, was arrested Friday on suspicion of second-degree assault while in custody, resisting arrest, driving under the influence and careless driving, police reports show.
Police said that after the crash, Smith failed roadside tests for driving under the influence. At the police station, Smith allegedly was combative, grabbed an officer’s shirt and vest, and kicked the officer, according to the police report.
The Boulder County Jail did not return a message asking that Smith be made available to comment.
Smith was due in court Monday in the case.
In January, Smith was sentenced to 60 days in jail and five years of probation after entering a plea to a charge of child abuse resulting in death.
His son, Shay, fell from an inflatable raft as it was towed behind the family’s boat July 15 on Carter Lake, near Loveland, and was presumed drowned. Investigators suspected Smith was towing his son at up to 30 mph with only the boy’s 3-year-old brother watching him.
Smith’s blood-alcohol content was above the legal limit for driving but within the legal standard for boating.
