Former Colorado State basketball player Xavier Kilby will appear in Larimer County District Court Monday morning.
He was arrested early Sunday on suspicion of felony menacing and misdemeanor prohibited use of weapons after pointing a gun at teammate Ronnie Aguilar.
Kilby, a 6-foot-8, 21-year-old freshman from Phoenix, was released from jail Monday afternoon on a $20,000 personal recognizance bond.
Fort Collins police department spokeswoman Rita Davis said Tuesday that police officers confiscated the weapon, a .22-caliber revolver.
Aguilar and another teammate, Stephan Gilling, were visiting Kilby’s off-campus apartment when an argument ensued. Initial police reports indicated Kilby fired the weapon into a couch. There were no injuries.
CSU coach Tim Miles, who has been on the job less than three weeks, said he couldn’t comment beyond his initial statement Monday condemning the behavior and banning Kilby from team activities.
Kilby was expected to leave the program prior to the incident. Even if he wanted to stay, the school’s judiciary committee would have the final say.
Miles, however, was clearly livid over the situation.
Aguilar, a 7-0 redshirt freshman, was at the spring football game Saturday. He said at that time some of his teammates would rather be closer to their homes out of state if they had to start from scratch with a new coaching staff.
Gilling, the program’s top 3-point shooter, and guard Tim Denson are also expected to leave.
With all of the turnover, the staff had two recruits in for the weekend.
