A judge sentenced a 17-year-old boy to 20 years in prison for the shooting and killing of a woman who dared him to shoot her after he threatened her with a gun.

Frankie Adan Montoya pleaded guilty to a lesser charge of second-degree murder in the heat of passion in the July 29th death of 30-year-old Barbara Alcon. He had been charged with first-degree murder.

District Judge David Cole on Tuesday could have sentenced Montoya to up to six years of rehabilitation in the Youthful Offender System prison. Instead, Cole sentenced Montoya to prison, which prompted Alcon’s family to react with applause.

Cole scolded them, yelling: “This isn’t a movie!”

Cole said the Youthful Offender System is more appropriate for lesser offenses where no one lost their life.

“We’re talking about a death here,” Cole said in explaining his sentence.

The shooting happened after Alcon, the mother of another teen, and Montoya began arguing over Montoya’s possession of a gun. According to police, Montoya pointed the gun at Alcon who pushed him and told him not to point it at her.

Alcon said: “Go ahead! If you got the balls, then do it,” daring him to shoot.

The arguing continued until Montoya told Alcon, “When I take the safety off, you better not push me.”

Alcon then pushed Montoya again and said, “Go ahead, shoot me.”

Montoya then shot her.
