GREENWOOD VILLAGE, Colo.—Reserve Denver Nuggets forward DerMarr Johnson was simply breaking up a fight between two women and charges stemming from a disturbance outside a nightclub should be dismissed, his attorney said Wednesday.

Johnson faces a charge of resisting arrest and interfering with a peace officer. He, along with two women were arrested in the incident that took place on June 9. The women were charged with disturbing the peace.

Police said they had to use a Taser on Johnson to calm him down.

“I’m hoping that I persuaded the prosecutor to dismiss the case,” Dan Recht, Johnson’s attorney said after meeting with prosecutors Wednesday.

When asked about the possibility of dismissing the charges, Elizabeth Shifrin, the municipal prosecutor, said, “We’ll see. I’m going to meet with him (Recht) over the next week and we’ll see what we can do. I want to make sure it’s fair for all three parties.”

Johnson is due back in court Wednesday for another hearing.

The 6-foot-9 Johnson is in his sixth season in the NBA. He averaged 3.5 points and 1.5 rebounds in 10.7 minutes last season.
