AURORA, Colo.—Police say no charges will be filed against the driver of a pickup truck that hit a 2-year-old boy as he was crossing a street in Aurora.

Police Lieutenant Troy Edwards says the driver’s blood alcohol level was below the .05 limit for driving while impaired, and that the driver was not responsible for the accident.

Authorities made that determination after discussing the findings of a lab test with the Arapahoe District Attorney’s Office.

The driver’s name has not been released.

The boy was hit about 9 p.m. August 16th when he ran across the street to join his father, who’d gone to talk with a neighbor.

The child was initially listed in critical condition, but Edwards says the boy is doing better and may go home from a hospital next week.
