DENVER—The Colorado Supreme Court agreed Thursday to review a lawsuit filed by The Denver Post and The Associated Press to unseal the indictment against a man suspected in the disappearance of his missing 6-year-old daughter.

The media organizations sued Nov. 1 challenging a ruling in Arapahoe County District Court that sealed the indictment against Aaron Thompson of Aurora.

Thompson was indicted by a grand jury in May on 60 counts, including fatal child abuse, conspiracy to commit fatal child abuse, false reporting and concealing a death. His daughter was reported missing in November 2005, and authorities believe she is dead.

The Post and the AP want the state Supreme Court to declare the seal unconstitutional under state and federal laws.

The state Supreme Court ordered Arapahoe County District Judge Mark Hannen to explain why his order to keep the case secret “should not be immediately vacated” by Dec. 12.

In his decision, Hannen wrote that his order to seal was based on “the ages of the alleged victims” and their interests.
