Michael Hunter, 24, was advised today of a drunken driving charge filed against him in connection with a Nov. 2 road-altercation in Lakewood that left his passenger dead.

David Rossiter, 25, of Sheridan, Mont., was shot and killed during the incident by off-duty Arapahoe County Deputy Daniel Montana Jr., police say.

The case has been turned over by Lakewood police to the Jefferson County District Attorney’s Office, with some additional investigation still pending, officials said.

No charges have been filed in the shooting. Montana has been placed on administrative leave.

Hunter is free on $10,000 bond in the DUI case. Bond conditions include not leaving the state and not committing new felony violations. A pretrial conference is scheduled Jan. 10.
