NEW YORK — Former Tyco International Ltd. executive Richard D. Power must face civil fraud charges brought by the U.S. Securities & Exchange Commission, a judge has ruled.
In an opinion made public Thursday, U.S. District Judge Robert W. Sweet in Manhattan denied a motion by Power to dismiss the suit filed by the SEC last year.
Power, a former chief financial officer, was one of three ex-Tyco executives charged by the SEC in the lawsuit. The executives all reported to L. Dennis Kozlow ski, the company’s former chief executive.
