EVANSVILLE, Ind. — A former Army private charged with raping a 14-year-old Iraqi girl and killing her and her family will go on trial in April 2009, a federal judge in Kentucky ruled Tuesday.

Green, 22, of Midland, Texas, is the only soldier charged in civilian court in the March 12, 2006, slayings of Abeer Qassim al- Janabi, her parents and her sister in Mahmudiya, about 20 miles south of Baghdad. He has pleaded not guilty to charges of rape and murder.

Four soldiers from the 101st Airborne Division based in Fort Campbell, Ky., have been convicted in military court and are serving sentences ranging from five to 110 years.

Prosecutors have said they will seek the death penalty for Green.
