The Colorado Court of Appeals has ruled in favor of the state Department of Public Health and Environment over its construction permits for the Comanche Power Plant’s new unit near Pueblo.
Citizens for Clean Air & Water in Pueblo and Southern Colorado and Clean Energy Action alleged that errors occurred when the state granted the permits to Xcel Energy.
But in a decision announced Thursday, the appeals court upheld those permits.
The court said the health department did not act arbitrarily in granting permits, despite the complaints that state officials didn’t investigate an earlier pollution violation cited by the Environmental Protection Agency.
