DOUGLAS COUNTY — A 65-year-old Douglas County man who shot and killed a man who broke into his home will not face charges.

According to Cocha Heyden, a public information officer with the Douglas County Sheriff’s Department, the District Attorney’s Office declined to file charges against William Fresch, 65, in the shooting death of Joseph Boone, 42, of Parker.

“While the case is still open for investigation, the District Attorney said Fresch was justified under Colorado law to protect himself,” Heyden said.

Sheriff’s deputies on Sunday responded to a call about an intruder at 11961 S. Highway 83 and a report that the homeowner had shot the intruder, according to a release from the Douglas County Sheriff’s Office.

Heyden said that Fresch and Boone did not know each other.
