Two people have been arrested in connection with a home break-in in Douglas County that ended with a shooting death.
William Fresch, 65, will not be charged in the shooting death of 42-year-old Joseph Boone, of Parker, according to the Douglas County Sheriff’s Office.
Fresch and Boone did not know each other, the sheriff’s office said.
Fresch was justified in shooting Boone under Colorado’s “make my day” law, which protects homeowners who take action against intruders.
Cheri Penn, 36, of Colorado Springs, has been arrested on suspicion of burglary, conspiracy and tampering with evidence, the sheriff’s office said.
Investigators said Penn was with Boone on Sunday on Fresch’s property, on the 11000 block of S. Highway 83, when the incident happened.
Penn drove away from the shooting scene, to Colorado Springs, in Boone’s vehicle, the sheriff’s office said.
In Colorado Springs she met with Robert Garner, 53, and told him about the break-in and shooting, according to the sheriff’s office.
Garner has also been arrested on suspicion of accessory to crime, tampering with evidence and obstruction, the sheriff’s office said.
