An assistant district attorney in Greeley has been suspended for 30 days after a traffic stop revealed his blood-alcohol content was .07.
Michael Rourke, 36, was stopped for speeding the night of May 1. During the stop, Rourke was tested for alcohol and later found to have a blood-alcohol content of .07. That’s under the legal limit of .08, but can sometimes bring a lesser charge of driving while ability impaired.
Weld County District Attorney Ken Buck suspended Rourke for 30 days without pay and said Rourke will be suspended from his duties until his criminal charges are settled. Buck said he will determine Rourke’s future depending on the outcome of his prosecution. Rourke makes roughly $125,000 a year.
Rourke has no criminal record. After graduating from the University of Denver law school, he spent eight years as a deputy district attorney in Arapahoe County, then came to the Weld County DA’s office. In 2007, he was promoted to assistant district attorney, the No. 2 man in the office. He also serves on the community-corrections board and as a legal adviser to several victims groups.
