Legal troubles continue to mount for the Mundy brothers of Jamestown, after older brother David showed up in court for a first appearance Wednesday with a walking cane that concealed a 15-inch blade, according to the Boulder County Sheriff’s office.

The Mundys — David, 45, and Michael, 44 — already had violated the terms of their release from an arrest on Aug. 14 after a bizzare standoff with three lawmen at Michael Mundy’s home.

The two brothers were not to be together while out on bond, but arrived together for David Mundy’s court appearance Monday. Witnesses already had told investigators that Michael Mundy was present when his brother bought the tricked-out walking stick over the weekend, the sheriff’s department said.

“As part of the investigation, we’ve been dealing with some of David’s mental health issues,” said Boulder County Sheriff’s Sgt. Tom McGrath.

The Mundy’s troubles started Aug. 13, when Michael, a usually reliable worker, had not checked in with his employer, an Internet company. When sheriff’s deputies did a courtesy check at his home that afternoon, no one was home, but the yard was littered with dead squirrels.

The next day, two deputies returned with an animal control officer to investigate. Michael came out of his house and became irate, and David Mundy picked up an ax and smashed their patrol cruiser, according to the Sheriff’s Department.

David Mundy wiggled away from an errant shot from a Taser, as Michael Mundy lifted a walking cane in a way that made a deputy was holding a rifle or shotgun, a sheriff’s spokesman said last week.

Michael Mundy was winged with a beanbag shotgun, but was able to run away for a short distance with his brother, before both eventually gave up.

McGrath said neither of the brothers have had much trouble with the law, but David’s minor runs have stemmed from past mental health episodes, McGrath said.

“He’s not on medication and mental evaluations have determined he needs to be,” McGrath said.

The cause of death of the squirrels is still under investigation. They may have been poisoned, McGrath said.

“It’s not against the law to kill squirrels on your property — they’re classified as rodents,” he said. “But you can’t torture them, and that’s what we’re investigating.”

Both brothers are in the Boulder County Jail without bond. In addition to felony weapons and contraband charges tacked onto his rap sheet Monday, David Mundy was previously charged with first-degree assault, felony criminal mischief, possession of a small amount of marijuana, obstructing a peace officer and resisting arrest

Besides violating bond, Michael Mundy was charged as an accessory to his brother bringing the knife to the courthouse, after earlier being charged with obstructing a peace officer and resisting arrest
