BOULDER, Colo.—A Boulder district judge has decided against banning computers and cell phones from the trial of a man accused of causing the death of his 11-week-old son.
Judge Lael Montgomery issued the ruling Monday in the case of 29-year-old Alex Midyette of Louisville, who is charged with fatal child abuse in the March 2006 death of his son, Jason.
Prosecutors and defense attorneys filed a motion last week to ban phones and computers out of fear that blogging could allow witnesses to learn what was happening in court before they testified.
Montgomery said he expects lawyers to tell witnesses not to talk with each other or to read accounts of the testimony.
The trial is scheduled to begin Jan. 12 in Denver, where it was moved due to pretrial publicity.
