
DENVER—Opening statements are possible Thursday in the trial of a Louisville man accused of fatally injuring his 11-week-old son.
A jury is expected to be seated Thursday morning in the trial of 29-year-old Alex Midyette, with opening statements given shortly thereafter. Midyette is accused of fatal child abuse in the March 2006 death of his son, Jason. Doctors say the infant had more than 20 broken bones and a skull fracture.
Midyette’s trial had been postponed three times and moved twice before starting Monday in Denver District Court. Midyette claims his son wasn’t abused but suffered from a rare medical problem.
Midyette’s wife, Molly Midyette, was convicted of child abuse in 2007 and was sentenced to 16 years in prison. Prosecutors say she didn’t seek help for her son in time.
