A Denver jury decided to reconvene at 9 a.m. Tuesday to resume deliberations in the case of Alex Midyette.
Midyette, 29, of Louisville, is charged with child abuse resulting in the March 2006 death of his infant son, Jason.
The jury deliberated for one full day today after hearing closing arguments on Thursday.
Alex Midyette says he did not abuse the child and his lawyers say the baby’s injuries and fractures are likely the result of a rare metabolic disease.
Prosecutors say Midyette was a frustrated father who abused the infant over the course of his short life, ultimately fracturing the baby’s skull during a diaper change.
The case was moved to Denver because Midyette’s lawyers argued that he could not get a fair trial in Boulder County.
Jason Midyette’s mother, Molly Midyette, was sentenced to 16 years in prison after she was convicted last year of child abuse resulting in his death.
