Alex Midyette posted an additional $750,000 bond just hours after he was convicted of criminally negligent child abuse resulting in the death of his infant son. He was released from Boulder County Jail on Tuesday night.

Judge Lael Montgomery doubled Midyette’s bail amount to $1.5 million on Tuesday after the verdict was read.

Midyette, 29, of Louisville is facing up to 16 years in prison in the death of his 11-week-old son, Jason.

A Denver jury found him guilty of a lesser charge of criminally negligent child abuse causing death. The jurors split 9-3 over whether he was guilty of reckless and knowing child abuse resulting in death, which carries a maximum 48-year prison term.

The trial was held in Denver because Midyette’s attorneys argued that he could not get a fair trial in Boulder County.

Midyette’s defense during his trial was that Jason suffered from a metabolic disease that weakened his bones and mimicked the symptoms of child abuse.

Jason Midyette died on March 3, 2006.

Prosecutors told the jury that Midyette was a frustrated father more concerned with partying and that he abused his baby boy over Jason’s short life. The prosecution’s theory was that Midyette fractured Jason’s skull in a final blow while changing his diaper.

Jason’s mother, Molly Midyette, was convicted of failing to get her son medical care, a more serious felony that garnered her a 16-year prison term last year.

A hearing is set for 8:30 a.m. Thursday in Boulder County Court to discuss a sentencing date.
