BOULDER, Colo.—A Boulder County man convicted of criminally negligent child abuse in the death of his infant son is free on $1.5 million bond until his sentencing.
Twenty-nine-year-old Alex Midyette was convicted Tuesday in the death of his 11-week-old son, Jason. He posted bond and was released Tuesday night.
He faces up to 16 years in prison. Prosecutors and defense attorneys will meet Thursday to schedule a sentencing hearing.
Midyette was acquitted of a more serious charge of knowingly or recklessly causing the injuries that led to the boy’s death. That charge carried a prison term of up to 48 years.
His wife, Molly Midyette, was convicted of child abuse in December 2007 for failing to get medical attention for Jason. She is serving a 16-year sentence.
