GRAND JUNCTION, Colo.—Two Colorado legislators are considering exempting a commercial wastewater business from new rules for waste pits.

Republican State Sen. Al White of Hayden says he is working with Senate Minority Leader Josh Penry, a Grand Junction Republican, to exempt the Four Mile Creek Recycling Facility in Moffat County from some of the regulations.

Owner Ed Counts says the new rules could put him out of business.

Penry voted for the tougher rules, but he says there might be room to exempt existing operations that haven’t had serious problems.

The new pit rules that took effect in December apply to facilities where waste from oil and gas drilling is disposed. One of the new requirements is synthetic liners for pits.
